The important points
GeoFence is a consensual family location and safety tool. It is not an emergency service, its locations and driving estimates can be delayed or wrong, and it must never be used for secret or unlawful tracking. By creating an account or using the Service, you agree to these Terms and acknowledge the Privacy Policy.
1. Agreement and scope
These Terms of Service (“Terms”) are a binding agreement between you and the GeoFence service operator identified in the applicable Google Play listing (“GeoFence,” “we,” “us,” or “our”). They apply to the GeoFence Android application, joingeofence.com, and related services (the “Service”). If you do not agree, do not create an account or use the Service.
2. Eligibility and accounts
You must be legally able to enter this agreement. Users under 18 must have a parent or legal guardian review and accept these Terms and supervise their use. Children under 13, or the minimum digital-consent age in their country if higher, may not create an account unless GeoFence offers and the parent completes a legally valid parental-consent process.
Provide accurate account information, protect your password and invitation codes, and notify us if you suspect unauthorized access. You are responsible for activity on your account to the extent permitted by law. One person may not impersonate another or create an account for covert tracking.
3. What GeoFence provides
Depending on your device, permissions, region, and plan, GeoFence may provide private circles, map locations, saved places and geofence alerts, location and drive history, driving estimates, check-ins, safe-arrival plans, SOS alerts, notification inboxes, and other safety-related features. Features may change, be unavailable, or be offered as a preview. We may impose reasonable technical or usage limits to protect security and reliability.
4. Location sharing and consent
- You may use GeoFence to locate or monitor another person only with their informed consent or other clear lawful authority.
- You must make sure each circle member understands what is shared, who can see it, and how to stop sharing.
- You may not conceal the app, defeat Android permission indicators, pressure someone to remain in a circle, or use the Service for stalking, harassment, discrimination, employment screening, insurance decisions, or unlawful surveillance.
- Circle administrators must handle invitation codes responsibly and remove people who should no longer have access.
You remain responsible for complying with consent, privacy, recording, child-protection, and surveillance laws that apply where you and other members live.
5. Safety and accuracy notice
GeoFence is not a 911 service, emergency dispatcher, security company, roadside service, medical device, or substitute for direct communication. In an emergency, contact local emergency services. Do not delay seeking help because of information in the Service.
Location, activity, arrival, driving, crash, SOS, battery, and notification information may be delayed, incomplete, duplicated, or inaccurate because of device sensors, signal loss, battery settings, operating-system restrictions, server or network outages, user permissions, or human error. A map pin shows a reported or estimated location—not proof that a person is currently there. Drive scores and risk events are informational estimates and must not be used as evidence of legal fault or safe driving.
6. Permissions, devices, and data use
Core features require a compatible Android device, internet connection, and permissions such as precise and background location, physical activity, and notifications. Background operation may use battery and mobile data. You control system permissions and may revoke them, but doing so can delay or disable features. You are responsible for carrier charges, device settings, and keeping the app updated.
Our collection and handling of personal information is described in the Privacy Policy, which forms part of these Terms.
7. Free features, paid plans, and billing
GeoFence may offer a Free plan and paid plans with different limits, history windows, or safety features. Current features and prices are shown before purchase and may vary by country, taxes, promotions, or app-store rules.
If subscriptions become available through Google Play, purchases will be processed by Google Play under its terms. The purchase screen will disclose price, billing period, trial terms if any, and automatic renewal. Unless stated otherwise, subscriptions renew until canceled in Google Play. Cancellation stops future renewal but normally does not refund the current billing period; mandatory refund rights remain unaffected. Deleting GeoFence does not automatically cancel a store subscription, and canceling a subscription does not delete your GeoFence account.
Features displayed as unavailable or preview are not currently offered for purchase. We will not charge you without an affirmative purchase confirmation through an authorized billing flow.
8. Acceptable use
You agree not to:
- use the Service unlawfully, deceptively, abusively, or to threaten another person;
- access a circle, account, location, or record without authorization;
- share invitation codes publicly or knowingly expose another person’s sensitive location;
- interfere with the Service, bypass plan or security controls, overload infrastructure, introduce malware, scrape data, or reverse engineer the Service except where law expressly permits it;
- submit false emergency or safety alerts, spoof location to deceive others, or misrepresent driving information;
- use GeoFence for dispatch, fleet monitoring, critical infrastructure, or another high-risk activity for which it was not designed.
You retain ownership of profile images, place names, and other content you submit. You give GeoFence a limited, worldwide license to host, process, reproduce, and display that content only as needed to operate, secure, and improve the Service and comply with law. You represent that you have the necessary rights to submit it.
If you voluntarily provide product feedback, you allow us to use it without restriction or compensation, without identifying you publicly unless you agree.
10. GeoFence property
The Service, software, design, branding, and documentation are owned by GeoFence or its licensors and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the Android app for its intended purpose. No rights are granted except those expressly stated.
11. Third-party services
The Service relies on third-party platforms such as Supabase infrastructure, Google Maps Platform, Google Places, Google Play services, and Google Play billing if enabled. Their services may have separate terms and privacy practices. GeoFence is not responsible for third-party services outside our control, but we remain responsible for our own data practices as required by law.
12. Suspension, termination, and deletion
You may stop using GeoFence at any time. You may request account deletion in Settings → Account & Profile → Delete Account or through our deletion page. Circle owners may need to resolve ownership before deletion can finish.
We may restrict or suspend access when reasonably necessary to address fraud, abuse, security risk, legal requirements, nonpayment, or a material breach of these Terms. Where appropriate and lawful, we will provide notice and an opportunity to appeal. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limitations, and dispute terms—will survive.
13. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We do not promise uninterrupted operation, delivery of every alert, compatibility with every device, exact location or driving accuracy, prevention of harm, or a particular outcome. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
14. Limitation of liability
To the fullest extent permitted by law, GeoFence and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, goodwill, profits, or opportunity arising from the Service. For claims that may legally be limited, total liability will not exceed the greater of the amount you paid GeoFence for the Service during the 12 months before the event giving rise to the claim or US $100. These limits do not apply where prohibited, including liability that cannot be limited for fraud, willful misconduct, personal injury, or mandatory consumer rights.
15. Indemnity
Where permitted by law, you agree to defend and indemnify GeoFence from third-party claims resulting from your unlawful use of the Service, violation of another person’s privacy or consent rights, content you submit, or material breach of these Terms. This does not require you to indemnify GeoFence for its own unlawful conduct.
16. Changes and availability
We may change these Terms or the Service to improve features, security, compliance, or reliability. We will provide reasonable notice of material changes when required. If you do not agree to updated Terms, stop using the Service and delete your account. We may discontinue a feature or the Service, subject to applicable law and any commitments made for paid access.
17. Disputes and applicable law
Before filing a claim, please contact us so we can try to resolve it informally. These Terms are governed by the laws that apply to the GeoFence operator and the user, without overriding mandatory consumer protections. Courts or dispute-resolution bodies with lawful jurisdiction may hear unresolved disputes. This section does not prevent either party from seeking urgent relief for misuse of accounts, location data, or intellectual property.
18. General terms
If a provision is unenforceable, it will be adjusted only as much as necessary and the rest will remain effective. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer them as part of a business reorganization with appropriate notice. These Terms and the Privacy Policy are the complete agreement about the Service unless additional terms are presented for a specific feature.
